General terms and conditions (GT&C) – Germany

General

The company SAFETY Training Plus GmbH works exclusively on the basis of these general terms and conditions. These are an essential part of every contract concluded by SAFETY Training Plus GmbH, even if they are not expressly agreed again. Changes and/or additions require the written confirmation of SAFETY Training Plus GmbH to be valid.

Contract closure SAFETY Online Training (Online Shop)

The binding conclusion of the contract in our online store takes place only when you click on “Pay now” on the page of our payment processor. After payment is received, the purchase is marked as “Ordered” and “Paid” and an invoice is generated. This is followed by a binding contract, with the effect of which we assure you the service. Until the click on “Pay now” there is no binding contract.

Registrations / Number of participants

Course registrations must be made in electronic (internet, email) or written (letter, fax) form. Verbal registrations are not binding. With the registration the general terms and conditions of SAFETY Training Plus GmbH are accepted by the participant. Courses are held with a minimum of 4 participants. For pedagogical reasons, the number of participants is limited to 16. Exceptions are not always avoidable and do not entitle to a discount. Registrations are considered in the order in which they are received. If a registration in the desired course cannot be confirmed, the participant will be informed as soon as possible and an alternative date will be suggested if available.

Course confirmation / Invoicing

After receiving the registration, a course confirmation will be sent. Approximately three weeks before the course starts, the participant will receive the detailed course documents and the invoice. Course and accommodation costs will be invoiced separately and exclusively by SAFETY Training Plus GmbH.

Prices / Services

The prices communicated with the course confirmation or invoice apply. Unless special written agreements have been made, the course fee includes: The teaching of the training content specified in the course description. Course documentation, Rules and regulations and legal texts will be made available to all participants on loan for the duration of the course. The overnight flat rate (single room incl. breakfast, lunch and dinner) or the daily guest flat rate (conference drinks, lunch and coffee break – without overnight stay) will be invoiced together with the course fee.

Daily guest flat rate

All participants who attend the course as a day guest will be charged a day guest flat rate per day. A day guest is someone who has not booked hotel accommodation (full board with breakfast, lunch and dinner) for the duration of the course. The daily guest fee includes the conference drinks, lunch and coffee break in the morning and afternoon.

Change of booking / Cancellation

If a course participant is unable to attend the booked course, he/she is entitled to make a booking change in favor of a later course up to the 14th day before the start of the course after consultation with SAFETY Training Plus GmbH. Already paid course fees will be credited. Resignation Withdrawal from a booked course must be made in writing. A substitute participant can be named. A withdrawal up to the 30th day before the start of the course is free of charge. With resignation between the 30th and the 14th day before the start of the course, 50% of the course costs are due, after the 14th day before the start of the course we charge 100% cancellation fee. In case of non-attendance or cancellation of the course, the entire course fee must be paid. SAFETY Training Plus GmbH also has the right in such a case to refuse to issue a training certificate or a recognized qualification certificate at its own discretion. Hotel Reservations. In the event of cancellations of a hotel reservations, the costs will be passed on to the course participant in accordance with the respective hotels will be charged to the course participant. Online Training You have the right to cancel this contract within fourteen days without giving any reason. However, from initial registration on the online training platform, before the expiry of the withdrawal period, the execution of the contract is started. With the start of execution, the right of withdrawal expires.

Changes / Cancellations by SAFETY Training Plus GmbH

Changes A change of instructors, the seminar building or postponements in the schedule do not entitle the participant to withdraw or to reduce the fee, provided that the course content is not significantly affected and the seminar building is located within a reasonable distance. Cancellation SAFETY Training Plus GmbH reserves the right to cancel courses and events if a minimum number of participants is not reached or in case of unforeseen prevention of the speakers. In such a case, an alternative date will be proposed. If no agreement is reached on the alternative date, any participation fees already paid will be refunded in full without delay. Further claims are excluded.

In-house training

Price details For this we are happy to provide our offer. After written acceptance of our offer, we design the in-house training specifically according to your needs and orient the content according to the tasks of your employees. Each participant will receive a course folder with training materials to keep. After consultation and according to our offer, these training materials will be invoiced. We provide each participant with the legal regulations on loan and free of charge for the duration of the training. Travel, accommodation and shipping costs We charge travel costs for the outward and return journey between our place of business and the training location specified by you, irrespective of the actual choice of means of transport. We will pass on to you any overnight accommodation costs incurred and any shipping costs for the training documents upon receipt and without surcharge. Training room, media and equipment The training course comes to you, so the following requirements should be met there: Flipchart board with sufficient paper 2 pin boards (metaplan boards) covered with paper Internal if possible UN-coded packaging material and dangerous goods documents (e.g. work instructions, checklists, transport paper….) Cancellation of the in-house training by us If we are prevented from conducting the training due to illness or similar unavoidable events, we will first try to arrange a replacement date with you or we will offer a qualified replacement speaker. If no new date can be arranged or no substitute instructor can be offered, we will no longer be entitled to remuneration. Cancellation by you If you cancel the course later than 20 calendar days before the agreed date, 100% of the basic fee is due. No cancellation fees will be charged before this date. Booked overnight stays, flights and rental cars are also due at 100%.

Function external dangerous goods safety advisor

The function of external dangerous goods safety advisor is based on the individually agreed contract design with the appointment as external dangerous goods safety advisor.

Specialist book order

Orders for technical books are forwarded by SAFETY Training Plus GmbH to Verkehrs-Verlag J. Fischer GmbH & Co. KG, Düsseldorf. The prices quoted are net prices to which the statutory value added tax will be added. Plus shipping costs, depending on weight.

Disclaimer

SAFETY Training Plus GmbH is liable for damages during the course – regardless of the legal reason – only insofar as it is charged with intent or gross negligence. In case of loss, damage or theft of objects or vehicles brought along by the participants, liability remains excluded. SAFETY Training Plus GmbH assumes no liability for subsequent damage allegedly incurred in the course of implementing the course content imparted.

Place of jurisdiction

The place of jurisdiction is Burghausen/OBB. However, SAFETY Training Plus GmbH is entitled to assert any claims at any other competent court.

Course, examination and accommodation costs will be invoiced separately and exclusively by SAFETY Training.

Unless otherwise agreed, the course fee includes: – the teaching of the training contents specified in the course description, – the course documentation, – Lunch (for full-day courses) and conference drinks. For drinks during breaks: see point 5. The accommodation flat rate (single room incl. dinner and breakfast) will be invoiced separately.

Catering

One drink with lunch and one drink during each break are already included in the course price. If participants order additional drinks, they must pay for them themselves.

Rules and regulations

All rulebooks will be provided by SAFETY Training Plus GmbH to the course participants during the course. Except for courses in French. Participants of courses in French language are requested to bring their own rulebooks.

Change of booking / cancellation

In such a case, SAFETY Training also has the right to refuse to issue a training certificate or a recognized qualification certificate at its own discretion.

Changes / Cancellations by SAFETY Training

Examination for dangerous goods safety advisor according to GGBV (SR 741.622)

Admission: All holders of a valid training certificate according to Art. 17 GGBV are admitted to the GGBV examination, regardless of the training institution. (This certificate will be given after the GGBV training has been completed, provided that all teaching units have been attended). In addition, candidates must identify themselves with an identification document at the beginning of the examination. Registration: Registration is done by paying the examination fee. Payment must be received before the examination date. The examination fee can be refunded if participation in the examination is not possible for a reason for which the candidate is not responsible. Examination result: The exam result (with the training certificate, if any) will be sent to the examinees no later than 30 days after the exam.

Book order

Orders for technical books will be forwarded by SAFETY Training Plus GmbH to Verkehrs-Verlag J. Fischer GmbH & Co. KG, Düsseldorf. The prices quoted are net prices. No value added tax will be charged for delivery to Switzerland. Shipping costs will be included in the invoice. Delivery and invoicing will be carried out by Verkehrs-Verlag J. Fischer GmbH & Co. KG, Düsseldorf.

Privacy / Copyright Training Materials

. Data protection The participant and his/her employer agree that their data will be collected and processed by SAFETY Training by means of EDP. SAFETY Training assures that this data will be used exclusively for internal purposes (preparation of course documents, training certificates, etc.) and will not be passed on to third parties. Copyrights – training documents The course participant agrees to respect the copyright of all training materials provided and handed out by SAFETY Training. The training materials serve as aids and support for the training. Reproduction and/or further use of the contents beyond personal use is not permitted.

Place of jurisdiction

The place of jurisdiction is Reinach BL. However, SAFETY Training is entitled to assert any claims at any other competent court.
